the Eternit trial report, Torino (Italy)

December 10th, 2009. It's 10 AM. when the judge Giuseppe Casalbore gets in the maxi courtroom of the Palace of Justice of Turin, Italy, leading off the begin of the great Eternit trial.

It is not just the main lawsuit related to the asbestos epidemic worldwide but also a landmark in the knowledge of the asbestos danger and, we hope, a warning for a social responsible behaviour in the company managing in general.
The judge declares the defendant's absence then calls the roll, first the plaintiff's lawyers. A long list of names for more than 100 lawyers, everyone with his questions and considerations. Crowd and confusion falls in silence when Casalbore, commanding the proceeding, demands for respect for the celebration of the lawsuite. He requires that all the lawyers wear the mandatory black gown of the trial and call a camera for taking his baseball cap off. "The law states it and the good breeding too" he said.

At the end of this firs roll call, its time for the long and tragic list of 2889 victims: their presence or the presence of their relatives determine the chance to joine the plaintiff. Three big halls has been prepared to host all of them.
At the end of the call, after 8 hours, around 2100 people has joined the lawsuit. The start has been very resolved and all the registrations has been done in a single day. A court calendar has been also disclosed: next hearing on January 25th, than the court will adjourn every monday morning (except February the 1st, 2010).

Outside the Palace of Justice, the mass demonstration surrounded the Palace of Justice with the dignity and the colours of the workers and victim's association from all around the Europe: the miners of Bourgonge with their helmet with the torch on it; the friend from the Swiss CAOVA and a big banner: "Mister Schmidheiny, we wait for you in Switzerland also"; the Italiani with the flag on the shpulders and the sticker "Eternit: justice!" glued on the breast; the ABEVA friend coming from Belgium to testify their solidarity.

«Basta aminato! Strage Eternit: giustizia!» Sulle bandiere italiane, grandi ritratti in bianco e nero con, su ciascuno, il nome, l’età e la scritta «morto d’amianto» per i Francesi venuti da Dunkerque, dalle Ardenne, dalla Lorena e dalla Loira-Atlantica. Lunghi voltantini e ritratti anche per gli Svizzeri, un grande striscione per i Belgi: ieri mattina, il palazzo di giustizia di Torino aveva l’aspetto di una Babele europea per l’apertura del più grande processo mai organizzato sull’amianto, il primo penale in Europa. Quattro stabilimenti Eternit italiani (Casale Monferrato, Cavagnolo, Bagnoli e Rubiera), 2900 parti civili e due imputati: il magnate svizzero Stephan Schmidheiny, ex proprietario del gruppo di materiali da costruzione Eternit, oggi smagliante guru ecologista, e il barone belga Jean-Louis Marie Ghislan de Cartier, ex alto dirigente dell’impresa. Vi comparivano per aver provocato intenzionalmente una catastrofe sanitaria (2 200 morti, di cui 1 600 a Casale, e diverse centinaia di malati) e infranto le regole della sicurezza sul lavoro.

Il processo, che si prolungherà nel 2010, chiude trenta anni di lotte per le vittime italiane. «Per me, la lotta è iniziata nel 1982», racconta Romana Blasotti, la fondatrice dell’associazione delle famiglie delle vittime di Casale Monferrato, «quando mio marito, che lavorava allo stabilimento Eternit, si è ammalato». Un mesotelioma della pleura, il cancro che solo la polvere bianca provoca. Da allora, Romana Blasotti ha perso sua figlia, sua sorella, un nipote, una cugina. Tutti avvelenati, senza mai aver lavorato nello stabilimento, ma per aver vissuto in una città in cui la fibra assassina era ovunque: sulle tute da lavoro, ma anche nelle scuole e davanti alle case, poiché Eternit offriva delle lastre di amianto-cemento per la pavimentazione.

Da allora, la rabbia dimora in questa donna dagli occhi chiari. Nel 2004, con il sostegno della CGIL, ha presentato una denuncia presso il procuratore di Torino, Raffaele Guariniello. Per quattro anni questi ha istruito il dossier, fino a risalire ai più alti livelli di Eternit. E ottenere l’apertura di un processo che, secondo Sergio Bonetto, avvocato di 500 parti civili, «permetterà di ricostruire la storia dell’amianto in Europa e di fare luce su questi migliaia di morti». Ma non si tratta solo del passato. «Ogni anno, ci sono in Italia 35 nuovi decessi dovuti all’amianto», dice. «In Francia, 3000 persone muoiono ogni anno, vittime di questo veleno vietato nel 1997», testimonia Pierre Pluta, responsabile dell’associazione delle vittime dell’amianto a Dunkerque. È venuto a Torino con alcune vedove ed alcune vittime «per solidarietà ma anche perché si tratta di Eternit. Chiediamo un processo penale in Francia dal 1996». Jean-Paul Teissonnière, avvocato delle vittime francesi, ha la speranza che «questo processo, una prima mondiale, prefigurerà quello che succederà altrove». Così la messa in stato di accusa, il 25 novembre di Joseph Cuvelier, ex patron di Eternit in Francia «è in linea con quello che sta succedendo a Torino».
